We reserve the right to make modifications to these Terms and Conditions at any time and without prior notice. We recommend that you periodically review this page to stay informed of any changes. Continued use of the service after the posting of changes will imply acceptance of them.

3. Use of the Service

3.1. joymixa.com is an entertainment service that offers a music creativity game for people of all ages. You can access and enjoy the service on any compatible device.

3.2. The Service offers three access tiers:

Guest — unregistered, free access with usage limits (such as recording duration, recording slots, playlist count, and local soundbank count) as published on the pricing page. Usage limits for unregistered users may be modified at any time without notice.
Creator — paid subscription granting unlimited recordings, server sync across devices, and the ability to share recordings.
Producer — paid subscription granting all Creator features plus the ability to upload and publish original tracks to the library.

Paid membership costs and feature availability may change with twenty (20) days' prior notice.

3.3. The content and functions of joymixa.com are intended exclusively for personal and non-commercial use. In the future, new functionalities may be enabled for commercial purposes, which will be announced at least 20 days in advance. As long as a commercial version is not published, commercial use of joymixa.com is prohibited, and anyone infringing the non-commercial use of joymixa.com may be automatically expelled from the site without prior notice. It is prohibited to use the service for illegal purposes or contrary to these Terms and Conditions.

3.4. Access to and use of the service requires an Internet connection and a compatible device, which you must provide on your own. We are not responsible for any damage that the use of the service may cause to your computer, sound system, video game controller, or any other device associated with the use of our service.

3.5. Your account credentials are personal and non-transferable. You cannot assign, share, or sell your account, username, or password to third parties. You are solely responsible for the custody of your access credentials to joymixa.com.

3.6. Minors may use the service under the supervision and responsibility of an adult. The adult in charge will be responsible for any payment and billing associated with the membership and it is understood that the responsible adult or guardian has read these terms and conditions before starting to use the service that joymixa.com provides.

4. Payment Methods

Paid memberships grant access to the full set of features offered by joymixa.com. The cost and available payment methods are clearly specified on our website. Free access to core features does not require payment or registration.

5. Intellectual Property

5.1. All content on joymixa.com, including but not limited to texts, graphics, logos, and software, is the property of Ramiro Augusto Cosentino and is protected by international intellectual property laws. Any reproduction, distribution, modification, or unauthorized use of the content without our express consent is strictly prohibited.

5.2. By using our service, you acquire no ownership rights to the content or functionalities provided. Any unauthorized use of the content will constitute a violation of our intellectual property rights.

6. User-Uploaded Content

6.1. joymixa.com allows users to upload music, including tracks and their individual stems, for use by other users within the platform.

6.2. You may only upload content for which you own the copyright or have explicit authorization from the copyright holder. Content released under copyleft or non-commercial Creative Commons licenses is also accepted, provided you comply with the terms of those licenses.

6.3. By uploading content to joymixa.com, you retain full ownership of your intellectual property rights. You grant joymixa.com and its users a non-exclusive, royalty-free license to use, play, remix, and incorporate your content within the platform for non-commercial purposes. This license is limited to use within joymixa.com and does not transfer ownership or grant any rights for use outside the platform.

6.4. Downloading, extracting, or using any user-uploaded content outside of joymixa.com is strictly prohibited. Any such use constitutes a violation of these Terms and Conditions and may constitute a violation of the uploader's intellectual property rights. joymixa.com is not responsible for unauthorized use of content by third parties outside the platform.

6.5. Only encoded audio derived from uploaded content is made accessible to other users through the platform. Original uploaded files are stored securely by joymixa.com and are not made directly available for download or streaming.

6.6. We reserve the right to remove, classify, organize, or promote any content uploaded to joymixa.com at our discretion.

6.7. We reserve the right to remove any content that infringes copyright or violates these Terms and Conditions, without prior notice.

7. Content Policy

All content uploaded to or shared through joymixa.com must comply with the following rules. Violations may result in content removal and account suspension without prior notice.

The following content is prohibited:

Content that promotes racism, nationalism, xenophobia, sexism, homophobia, or any form of discrimination
Religious programs, missionarism, or sectarian propaganda
Political propaganda
Commercial advertising or obviously commercial music

8. Usage Analytics

8.1. joymixa.com collects anonymous usage data to improve the service. This includes information such as session duration, features used, device type (mobile, tablet, desktop), and general interaction patterns. No personal information, audio content, or individually identifiable data is included in the analytics.

8.2. Analytics data is retained for a maximum of 90 days and is automatically deleted after that period.

8.3. You can opt out of usage analytics at any time through the Privacy section in Settings. When you opt out, data collection stops immediately and any pending data is discarded.

8.4. We do not share analytics data with third parties.

9. Liability

9.1. joymixa.com is not responsible for direct or indirect damages that may arise from the use of the game, including, but not limited to, loss of profits, game interruption, or loss of data.

9.2. The use of the service and any action carried out by the user within it is the sole responsibility of the user. We are not responsible for any eventual or possible damages that could be caused by misuse of the service or by the conduct of other users.

9.3. joymixa.com is not responsible for physical or psychological damages caused by the use of the joymixa.com service in any case, whether it is due to repeated or prolonged use of it, or any other factor associated with its use.

10. Indemnification

You agree to indemnify and hold harmless joymixa.com and its employees, directors, agents, and all staff in general of any of the hierarchical levels of joymixa.com, from any claim, demand, liability, expenses, and costs, including attorney fees, that may arise as a result of your use of the service or any violation of these Terms and Conditions.

11. Applicable Law and Jurisdiction

These Terms and Conditions are governed by and interpreted in accordance with the laws of Spain. Any dispute arising in connection with the service or these Terms and Conditions will be subject to the exclusive jurisdiction of the competent courts of Spain.
